TERMS AND CONDITIONS (“TERMS”)

These Terms, together with any stipulated terms and conditions of each relevant Venue, set out the terms on which you make a Booking.

Please read these Terms carefully before making a Booking. They set out your rights and YGB’s obligations to you. By making a Booking you agree that you have read and understood these Terms and agree to be bound by them and confirm that you are booking as an individual.


1. Definitions

Booking Means a booking of a tee time or other service made by you at a Venue via the Website.

Booking Fees The fees payable by you when you make a Booking.

Loyalty Card

means your balance with the Venue, which may be topped up at any time from your account. It does not hold any monetary value, but can be exchanged for bookings or other services at the Venue, dependent on that Venue’s Venue Rules.

Venue

the bookable and/or searchable venues accessible on the Website, which may include golf clubs, driving ranges or more.

Venue Rules

means the rules of each Venue which will be provided to you at the time of making a Booking.

Website

the website located at www.yourgolfbooking.com.

YGB

means your Golf Booking.com Ltd a company registered in England and Wales with company number 07733449 whose registered office is at Gleneagles House, Hodge Lane, Windsor, Berkshire SL4 2DT.

You Your Golfers

means the person making the Booking via the Website.


2. Introduction

2.1 YGB provides a way for you to make Bookings at hundreds of individual Venues displayed on the Website. All Venues featured on the Website are not offers by YGB for you to make a booking but an invitation to you to make an offer to the Venue to book. Your Booking is not complete or legally binding on the Venue until such time as payment is received by the Venue.You will receive a confirmation email from YGB that your Booking is complete.

2.2 The legal contract for a Booking is between you and the Venue, and YGB acts on behalf of and as an agent for the Venue in question. YGB is not a party to the contract between you and the Venue. The contract will exist once payment is received by the Venue.

2.3 Any queries or concerns that you may have in connection with your Booking should be addressed directly to the Venue via the details set out in the confirmatory email.

2.4 Where the Venue’s terms and conditions are not featured on the Website, you should check the website of the Venue in question for any applicable terms that you need to be aware of, such as dress code, minimum handicaps or similar rules. In addition, the Venue may operate a different cancellation policy, which will override any cancellation terms within these Terms. YGB advise that you read the Venue’s terms and conditions carefully as they will contain important information about your Booking.

2.5 YGB may, at any time and for any reason without prior notification to you, terminate, restrict, suspend or discontinue your access to the Website if it feels in its absolute discretion that you are misusing the Website or if you are in breach of any of the provisions of these Terms.

2.6 YGB may at any time and for any reason cease providing the service through the Website without notification to you.


3. Bookings

3.1 You must sign into your account in order to make a Booking.

3.2 Once your Booking is made YGB will send a confirmation email.


4. Your responsibilities

4.1 You (including all individuals included within your Booking) are responsible for:

4.1.1 ensuring your information is correct and up to date at the time of making the Booking;

4.1.2 acting in accordance with any applicable Venue Rules;

4.1.3 arriving in good time before your allocated Booking (if you are running late please contact the Venue as soon as possible. Please note, Bookings are subject to availability and there is no guarantee that the Venue will be able to accommodate a new booking if you miss your original time);

4.1.4 providing proof of your Booking and payment, if requested by the Venue;

4.1.5 communicating any special requirements in advance to the Venue; and

4.1.6 checking the condition of the Venue on the day in advance of your Booking and ensuring the Venue is open and playable.

4.2 You accept that the Venue has discretion to refuse entry or request that you leave the Venue if you (including any individual within your Booking) do/does not adhere to the Venue Rules.

4.3 Owing to local conditions, some and/or all of the holes at the Venue may be closed and/or have temporary greens and/or have trolley/cart bans and/or similar restrictions.

4.4 There may be slow play or other situations which may affect your experience at the Venue and YGB will not be liable for such events.

4.5 Where you have any complaints, these should be directed to the Venue in the first instance for resolution.

4.6 YGB has no control over the act or omissions of the Venue.


5. Cancellations and Availability

Once you have submitted your Booking any changes or cancellations will be dealt with by the Venue. YGB is ultimately responsible for all chargebacks and refunds, however you should request these from the venue directly, who will then request the refund from YGB.

Please note there is no guarantee that the Venue will agree to your requests.


6. Price, Payment and Credit

6.1 Prices for bookings will be as quoted on the Website. These prices include any applicable VAT (which will be added to the total amount due where applicable).

Payments

6.2 Unless stated otherwise, payments for Bookings must be made in advance by an accepted credit or debit card through the Website (some credit or debit cards may not be accepted such as American Express) or using your Loyalty Card.

Credit

6.3 On a Loyalty Card and Reward Balance top-up, your account will be credited with a token, with the equivalent value stated when purchasing. These tokens have no monetary value and are non-refundable. They may expire as per the terms and conditions of the Venue that you bought them from.


7. Data Protection

7.1 YGB take its responsibilities and obligations in respect of data protection extremely seriously. Please see YGB’s Privacy Policy to find out more information about how YGB collects and uses your personal data through the Website. This is available through the footer of the website.

7.2 YGB provide the Venue with your personal data in order to process and fulfill your Booking. The Venue will process your personal data as data controller in accordance with its own privacy policy. Please read the relevant Venue’s privacy policy for more information.

7.3 Please visit our Privacy Policy for additional information on your rights to data access, deletion, objection and portability, as well as applicable retention periods.


8. Liability

8.1 Unless expressly stated to the contrary and to the fullest extent permitted by law, YGB exclude all conditions, warranties and other terms which might otherwise be implied by statute or law.

8.2 YGB act solely as a booking agent for the various Venues offered to you via the Website. As such, YGB have no liability whatsoever to you for any personal injury or death or any other loss that you may incur whilst at the Venue or otherwise.

8.3 YGB shall not be liable for any damages whatsoever, including without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of or related to your use, inability to use, performance or failure of the Website, or the actions or omissions of any Venue.

8.4 YGB’s total liability to you in respect of all other losses arising in connection with your Booking, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances be greater than; (i) 200% of the value of your Booking; or (ii) one hundred pounds/euros (£/€100).

8.5 Nothing in these Terms excludes or limits YGB’s liability for death or personal injury arising from its negligence, its liability for fraudulent misrepresentation, or any other liability which cannot be excluded or limited under applicable law.


9. Closing your account

You may close your account at any time by contacting Customer Support.


10. Force Majeure

YGB will not be liable for additional expenses incurred through travel delay, acts of God or any other events beyond its control. In such an event, YGB cannot pay any compensation, reimburse expenses or cover losses for any amount or otherwise accept responsibility if, as a result of such an event, YGB changes your Booking or the Venue cannot carry out your Booking.


11. Miscellaneous

11.1 YGB reserves the right, at any time and in its sole discretion, to amend these Terms. Please check this page from time to time to take notice of any changes YGB have made as they are binding on you. Your continued use of the Website following any such change will constitute your acceptance of such changes.

11.2 If any of these Terms are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

11.3 Any failure or delay by you or YGB in enforcing (in whole or in part) any provision of these Terms will not be interpreted as a waiver of your or YGB’s rights or remedies.

11.4 YGB will contact You by email, telephone or provide you with information by posting notices on the Website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that YGB provides to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

11.5 The cancellation rights contained in the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 do not apply to the sale of Bookings via the Website.


12. Dispute Resolution and Complaints

12.1 YGB are committed to delivering excellent customer service. If you are not happy with the service YGB provides, please contact Customer Support.

12.2 If this does not resolve your complaint, you can upload your complaint via the European Commission's ODR platform which can be found here: http://ec.europa.eu/odr.

12.3 If your complaint is about your experience or service received whilst at the Venue, you should direct your complaint to the Venue directly. If you are not satisfied with the Venue’s response or resolution, then please contact Customer Support who will endeavour to remedy the situation between you and the Venue. However, please note, YGB are not responsible for the actions or omissions of the Venue and cannot control or mandate that the Venue do anything, including providing you with a resolution or remedy to your complaint.

12.4 These Terms and any Bookings made through the Website are governed by and construed in accordance with the laws of England & Wales and the English courts shall have exclusive jurisdiction.
